- “Service”: All functionalities offered by TradeBench, including software, web, and mobile applications.
3. Eligibility
- You must be at least 18 years old and legally capable of entering into binding agreements.
4. Account Registration
- To use TradeBench, you must create an account with accurate, complete information and maintain its confidentiality. Notify us immediately of unauthorized use.
5. License Grant & Restrictions
- We grant a non-transferable, limited license to use our services as intended. You must not:
- Modify, distribute, or reproduce TradeBench software.
- Use automated systems (e.g., bots) to access the service.
- Violate any laws or rights of third parties in your use.
6. User Content
- Users are responsible for content uploaded or shared on TradeBench, ensuring it is lawful, accurate, and non-infringing.
- TradeBench reserves the right to remove content deemed inappropriate or violating these Terms.
7. Data Privacy & Security
- We collect and process personal data as outlined in our Privacy Policy. Data is stored securely and used solely for service purposes.
- Users must maintain the confidentiality of their account credentials. TradeBench is not responsible for data loss due to user actions.
8. Subscription and Payment Terms
- Subscription Plans: Users may subscribe to monthly, or annual plans. Fees are due upfront and non-refundable.
- Payment Details: You authorize TradeBench to charge the payment method provided.
- Renewal and Cancellation: Subscriptions renew automatically and can be cancelled anytime through account settings.
- Refund Policy: Refunds may be granted on a case-by-case basis, primarily for service errors.
9. Service Availability & Modifications
- We strive for 99.9% uptime. However, we do not guarantee uninterrupted service and reserve the right to modify, suspend, or discontinue the service with or without notice.
10. Third-Party Integrations
- TradeBench may offer integrations with third-party services. You acknowledge that use of these services is subject to their respective terms and conditions, not ours.
11. Limitation of Liability
- To the extent permitted by law, TradeBench is not liable for indirect, incidental, special, or consequential damages, including loss of revenue, profits, data, or use, even if advised of the possibility of such damages.
- Our total liability, regardless of the cause, is limited to the amount paid for the service within the last 12 months.
12. Indemnification
- You agree to indemnify and hold harmless TradeBench, its affiliates, employees, and partners from any claims, damages, or liabilities arising from your use of the service or breach of these Terms.
13. Termination
- We reserve the right to terminate or suspend access to TradeBench for violations of these Terms or at our sole discretion. Users can terminate their account at any time by contacting support.
14. Governing Law & Jurisdiction
- These Terms are governed by the laws of Ontario, Canada. Any disputes will be resolved in Ontario’s courts.
15. Changes to Terms
- We may update these Terms occasionally. We will notify users of significant changes via email or site notification. Continued use constitutes acceptance of the revised Terms.
